Terms of Use

These Terms of Use (the “Terms”) are a binding agreement between you and MoneyPicnic LLC (“MoneyPicnic,” “we,” “us,” or “our”) and govern your access to and use of MoneyPicnic.com, our questionnaires and personalized reports, our email and SMS communications, and any related tools, features, or services we make available (together, the “Services”).

By visiting the site, completing a questionnaire, creating an account, or clicking through to a partner offer, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

If you use the Services on behalf of a business or another person, you represent that you have authority to accept these Terms on their behalf.

MoneyPicnic is an advertising-supported financial opportunity marketplace. We help consumers discover, compare, evaluate, and apply for financial products and services using our proprietary recommendation technology. We are not a credit card comparison table with a search box — the Services are designed to look at the information you choose to share and surface the opportunities most likely to move your situation forward.

Depending on availability and your profile, the categories we may present include:

• Personal loans

• Home equity lines of credit (HELOCs)
• Auto loans
• Student loan refinancing
• High-yield savings accounts
• Checking account bonuses
• Investing products and platforms
• Insurance products

What we are not, stated plainly: MoneyPicnic is not a lender, bank, credit union, mortgage broker, loan broker, insurance carrier, investment adviser, broker-dealer, credit repair organization, credit services organization, or debt settlement company. We do not make lending or underwriting decisions, we do not set rates or terms, we do not hold deposits, and we do not guarantee that you will be approved for anything.

Every credit, account, coverage, or pricing decision is made solely by the third-party financial institution, lender, issuer, carrier, or provider you choose to apply with.

To use the Services you must be at least 18 years old (or the age of majority in your state, if higher), a resident of the United States, and legally able to enter into a binding contract. The Services are intended for personal, non-commercial use.

We do not knowingly collect information from anyone under 18. Some offers, features, or partners may be unavailable in your state, and availability can change without notice. We may decline, limit, or discontinue access to the Services for any lawful reason.

Many parts of the Services work without an account. If you do create one, you agree to provide accurate information, keep it current, and keep your login credentials confidential. You are responsible for activity that occurs under your account.

Tell us promptly at support@moneypicnic.com if you believe your account has been accessed without your permission. You may close your account at any time; we may retain certain records as required by law or as described in our Privacy Policy. We may suspend or terminate an account that violates these Terms, appears fraudulent, or creates risk for other users or our partners.

The quality of your recommendations depends on the accuracy of what you tell us. You may share information such as your name, contact details, state, income, housing status, estimated credit range, existing debts, goals, and timeline. You agree that the information you submit is truthful, accurate, and yours to share.

You grant MoneyPicnic a license to use, store, process, and analyze the information you submit in order to operate and improve the Services, generate and refine your recommendations, match you with partners you ask to be matched with, and communicate with you. We handle this information as described in our Privacy Policy.

Please do not submit information you are not authorized to provide, and do not send us sensitive information we have not asked for.

When you complete a questionnaire or request a personalized report, you authorize MoneyPicnic to use the information you provided — together with our recommendation technology and data from our partners — to identify products and services that may fit your situation, and to present those results to you.

Soft credit inquiries. In some cases we may offer to check credit information to sharpen your results. We will only obtain a soft credit inquiry (also called a soft pull) when you explicitly authorize it on a screen that says so. A soft inquiry does not affect your credit scores and is not visible to lenders as an application. Where a soft inquiry is used, you authorize MoneyPicnic and its service providers to obtain your consumer report and score from one or more consumer reporting agencies for the purpose of presenting personalized results to you, and you acknowledge this authorization is a written instruction under the Fair Credit Reporting Act.

Any hard credit inquiry happens only if and when you choose to apply directly with a third-party provider, under that provider’s own terms and authorizations. Credit score data shown in the Services, if any, may be a VantageScore® 3.0 or similar educational score provided by a consumer reporting agency, and may differ from scores used by lenders.

You may withdraw your authorization for future matching at any time by closing your account or contacting us; withdrawal does not undo processing that has already occurred.

We want to be direct about how we make money, because you should be able to weigh it. MoneyPicnic is free for you to use because it is advertising-supported. We receive compensation from many of the companies whose products appear in the Services — typically when you click an offer, submit an application, or are approved for a product.

That compensation can influence which partners are available to us and where certain offers appear, including the order in which some listings are displayed within a category or on a page. MoneyPicnic does not include every company or every offer available in the marketplace, and the offers you see are not a complete survey of the market.

What compensation does not do: it does not create eligibility you do not have, it does not change the disclosures a partner is required to show you, and it does not stop us from telling you the downsides of a product or that no product is the right answer right now. Our recommendation technology weighs relevance and expected benefit to you alongside commercial factors, and we design our reports to surface trade-offs, considerations, and who should skip an offer.

Rates, terms, fees, bonuses, and availability shown in the Services are supplied by partners or gathered from public sources and can change at any time. Always confirm the current terms on the provider’s own website before applying.

Our recommendation technology evaluates a number of signals to decide what to show you and in what order. Depending on the product category, those signals may include:

• Information you supply in a questionnaire or your account
• Partner eligibility requirements and underwriting criteria
• Estimated approval likelihood based on the profile you describe
• Which offers are actually available to us at that moment
• The goals, priorities, and timeline you tell us about
• Historical performance data across similar user profiles
• Proprietary AI, machine learning, and statistical models
• Advertiser compensation and other commercial arrangements
• General relevance, product quality, and fit to your situation

These signals are weighted, not absolute. A high estimated approval likelihood is an estimate, not a decision. A high expected value is a modeled projection based on assumptions that may not hold for you.

Recommendations are informational only. They are not offers of credit, promises of approval, predictions of terms you will receive, or professional advice. You are always free to ignore them.

Estimated values, savings figures, interest-avoided amounts, bonus amounts, confidence percentages, match scores, timelines, and approval likelihoods shown in the Services are illustrative estimates generated by models. They are not guarantees, appraisals, quotes, or commitments, and your actual results will differ.

We do not guarantee that any product will be available to you, that you will be approved, that you will receive any particular rate, limit, bonus, or term, or that following a recommendation will improve your credit or financial position. Only the provider can tell you what you actually qualify for.

You are solely responsible for your financial decisions. Read every disclosure, agreement, fee schedule, and set of terms and conditions from a provider before you accept a product.

MoneyPicnic provides educational information, comparison content, and personalized product matching. We do not provide legal, tax, accounting, investment, insurance, or individualized financial advice, and nothing in the Services creates a fiduciary, advisory, brokerage, or professional relationship between you and MoneyPicnic.

We are not a registered investment adviser or broker-dealer and do not recommend securities. Content in the Services is general in nature and does not account for your full circumstances. For advice tailored to you, consult a licensed professional such as an attorney, CPA, registered investment adviser, or licensed insurance agent.

You agree that we may communicate with you electronically, and that electronic notices, disclosures, and agreements satisfy any requirement that a communication be in writing.

Email. When you provide your email address, we may send you your report, service and account messages, and — where permitted — educational content and offers. You can unsubscribe from marketing email using the link in any message; we may still send transactional and account-related messages.

SMS. We send text messages only where you have provided consent. Message and data rates may apply, message frequency varies, and consent to receive marketing texts is not a condition of any purchase or of receiving recommendations. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages.

Automated technology. Where you consent, we may contact you using automated dialing or messaging technology. Keep your contact information current so our messages reach you rather than someone else.

When you click an offer, you will typically leave MoneyPicnic.com and be taken to a third party’s website. If you choose to apply, you provide your application information directly to that third party — not to MoneyPicnic — and that company’s terms and privacy policy govern what happens next.

We do not control third parties and are not responsible for their products, pricing, disclosures, underwriting, servicing, customer support, data practices, or acts and omissions. A product appearing in the Services is not an endorsement or a warranty of suitability. Disputes about a third-party product must be resolved with that third party.

The Services and everything in them are owned by MoneyPicnic LLC or its licensors and are protected by copyright, trademark, trade secret, patent, and other laws. Protected materials include, without limitation:

• The MoneyPicnic name, brand, and all related marks and taglines
• Our logo, logomark, and visual identity
• Source code, software, and technical architecture
• Algorithms, scoring logic, weightings, and methodology
• Our recommendation engine and matching systems
• AI models, training pipelines, prompts, and model outputs
• Databases, data compilations, and structured offer data
• Written content, reports, educational material, and copy
• User interface and user experience design, layouts, and flows
• Graphics, illustrations, icons, typography treatments, and imagery

We grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Services for your own personal financial purposes. You may not copy, reproduce, republish, scrape, frame, mirror, sell, license, reverse engineer, decompile, or create derivative works from any part of the Services, or use them to build or train a competing product, dataset, or model, without our prior written permission.

Third-party names, logos, and marks shown in the Services belong to their respective owners and are used to identify their products. If you submit feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

You agree not to:

• Submit false, misleading, or stolen information, or impersonate anyone
• Use the Services for any unlawful, fraudulent, or abusive purpose
• Apply for products on behalf of another person without authority
• Scrape, crawl, harvest, or bulk-download content, offers, or data
• Use bots, scripts, or automation to interact with the Services
• Attempt to access accounts, systems, or data that are not yours
• Probe, disrupt, overload, or interfere with the Services or our security
• Introduce malware or attempt to bypass rate limits or protections
• Remove, obscure, or alter disclosures, disclaimers, or attributions
• Resell, sublicense, or commercially exploit the Services or our data
• Use the Services to generate leads for, or to build, a competing service

We may investigate suspected violations, remove content, and suspend or terminate access, and we may report unlawful conduct to the appropriate authorities.

MoneyPicnic uses artificial intelligence, machine learning, statistical modeling, automation, and proprietary recommendation systems to personalize your experience, estimate fit and expected benefit, order results, generate explanatory content, and improve the Services over time.

These systems produce probabilistic outputs. That means results can be incomplete, imprecise, or occasionally wrong, and two similar profiles may see different results. Your recommendations may change — sometimes materially — as you provide more information, as your circumstances change, as partner offers and eligibility rules change, or as we retrain and improve our models.

AI-generated explanations, summaries, and estimates are provided for your understanding and are not professional advice or a substitute for a provider’s official disclosures. We use the information you provide, in de-identified or aggregated form where practical, to evaluate and improve our models as described in our Privacy Policy. Automated outputs are not the final word: you decide whether to act, and you should verify anything material before you do.

Our Privacy Policy explains what information we collect, how we use and share it, how long we keep it, the choices you have, and how we protect it. The Privacy Policy is incorporated into these Terms by reference, and by using the Services you agree to it.

We do not sell or rent your personal information to unrelated third parties for their own independent marketing. When you ask to be matched or choose to apply, we share the information needed to complete that request with the partner involved. The Services are provided “as is” and “as available.” To the fullest extent permitted by law, MoneyPicnic disclaims all warranties, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, that content, rates, or offer details will be accurate, current, or complete, that estimates or recommendations will prove correct, or that any result or outcome will be achieved. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

To the fullest extent permitted by law, MoneyPicnic LLC and its members, officers, employees, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, lost data, lost opportunity, loss of goodwill, credit denial, or credit score impact, arising out of or relating to the Services — even if we were advised of the possibility of such damages.

Our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the total amount you paid us, if any, in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

These limits apply regardless of the legal theory, apply to the maximum extent permitted by law, and are an essential part of the bargain between us. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to defend, indemnify, and hold harmless MoneyPicnic LLC and its members, officers, employees, agents, and service providers from and against any claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, information you submit, your violation of these Terms or of any law, your infringement of another party’s rights, or your dealings with any third-party provider.

We may assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with us in that defense.

Informal resolution first. Before starting an arbitration, you agree to contact us at legal@moneypicnic.com with a written description of the dispute and the relief you seek, and to give us 60 days to resolve it informally. Most issues can be sorted out this way.

Agreement to arbitrate. If we cannot resolve the dispute informally, you and MoneyPicnic agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services — including their formation, interpretation, breach, or termination — will be resolved exclusively by final and binding individual arbitration, and not in court. This agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq.

Individual basis only; no class actions. Arbitration will be conducted on an individual basis only. You and MoneyPicnic each waive any right to participate in a class, collective, consolidated, mass, or representative action, and an arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, and the rest of this section remains in force.

Procedure and venue. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, by a single arbitrator. The seat and venue of arbitration will be Florida, and any in-person hearing will take place in the county in Florida where MoneyPicnic maintains its principal place of business, unless the parties agree otherwise or the arbitrator determines a different location is necessary to avoid undue hardship. You may elect a telephonic or document-only proceeding where the rules allow. The arbitrator may award any relief available in an individual action in court, and judgment on the award may be entered in any court of competent jurisdiction.

Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property or prevent unauthorized access to the Services.

30-day opt-out. You may opt out of this Arbitration Agreement by sending written notice within 30 days of first accepting these Terms to MoneyPicnic LLC, Attn: Legal — Arbitration Opt-Out, or by email to legal@moneypicnic.com, including your name, the email address associated with your use of the Services, and a clear statement that you wish to opt out of arbitration. A timely opt-out will not affect any other part of these Terms, and we will not retaliate for it. If you opt out, disputes will be resolved in the courts identified in Section 21.

This Arbitration Agreement survives termination of these Terms and the closure of your account.

These Terms and any dispute between you and MoneyPicnic are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles.

Subject to the Arbitration Agreement in Section 20, you and MoneyPicnic agree to the exclusive jurisdiction and venue of the state and federal courts located in Florida, and each party waives any objection to that venue.

We may update these Terms from time to time as the Services, our partners, or the law change. When we do, we will revise the “Last updated” date above, and for material changes we will provide additional notice — for example, a notice in the Services or an email to registered members.

Continuing to use the Services after an update takes effect means you accept the revised Terms. If you do not agree, stop using the Services and, if you have one, close your account. We may also modify, suspend, or discontinue any part of the Services at any time.
